The same day, the SEC announced that they will not be suing Apple, Inc. Jobs may still be in their sights--it remains to be seen. They have settled with the former CFO and filed suit against the former General Counsel.

Actually, it does not remain to be seen. The SEC specifically said it will not be suing Jobs and that it has not shown him any favoritism. Fred's statement about Jobs being partially to blame might be new news for the public, but I guarantee it is not new news for the SEC. The SEC has had access to all of Apple's internal documents for over a year, has reviewed Fred's claims, and has interviewed Jobs personally. It decided Jobs did nothing wrong. The SEC could care less that Jobs is a highly popular guy.

The only remaining issue is will the Department of Justice bring criminal charges against Jobs. However, that seems very unlikely because the DOJ generally takes the lead of the SEC.

on the wall in Redmond right now.

When Microsoft announces their quarterly results this afternoon, does anybody think they'll be up 3x the industry average?

They exceed everyone's expectations, even their own. Why? Because Vista and Office 2007 were such big successes. Microsoft posted a 65% jump in third-quarter profit.
